1)                Stay and Play Vacations, Inc. is also known as StayandPlayVacation.com. StayandPlayVacation.com is an internet portal for Michigan-based resort businesses and Michigan-based resort property owners to promote their properties and businesses. Stay and Play Vacations, Inc. reserves the right to promote only properties and businesses physically located in the State of Michigan.

2)                StayandPlayVacation.com is owned and operated by Stay and Play Vacations, Inc. We are an independent contractor and claim no agency, partnership, joint venture; employee or employer; franchisor or franchisee relation is intended or created by these terms or your use of the site.

3)                Stay and Play Vacations, Inc. reserves the right to revise the rates prior to entering a contract or upon contract renewal.

4)                Stay and Play Vacations, Inc. is not responsible nor assumes responsibility for the accuracy of the information contained in any of the pages published on this site.

5)                Stay and Play Vacations has no responsibility between travelers and property owners and advertisers, we are only a portal to bring travelers and owners together.

6)                Stay and Play Vacations assumes no responsibility for the contract or financial viability or collections between the advertisers and travelers or consumers.

7)                Renters are aware that each property sets its own refund and cancellation policy and each entity have its own rules concerning refund and cancellation policies. We are not responsible for refund or rental fees for any reason.

8)                Stay and Play Vacations, Inc. does not warrant or guarantee the condition of the rental property nor do they warrant or guarantee any entity that advertises on StayandPlayVacations.com.

9)                Advertiser represents that there is nothing in any advertisement or any material for which the advertisement links that violates any law or government regulation. Advertiser agrees to indemnify and hold harmless Stay and Play Vacation, Inc., it’s employees and representatives against all liability, loss, damage and expense of any nature including attorney fees arising out of publishing, distribution or transmission of any advertisement submitted by or on behalf of the advertiser or the linkage of any advertiser of linkage of any advertisement to any other material or the loss, theft, use, or misuse of any credit or debit card or other payment, financial or personal information.

10)           All property listings on the site are submitted by the member and are the responsibility by the member, and we specifically disclaim any and all liability arising from the alleged accuracy of the listings or advertisements, property reviews, guest book entries, or any alleged breaches of contract on a property owner or agent, or advertiser’s part.
Advertisers and property owners or their agents  are solely responsible for keeping their property information up-to-date on the site, including, but not limited to any and all representations about the property, it’s amenities, location, and it’s availability for a specific date or range of dates. However, we reserve the right at all times to disclose any information as permitted by prevailing law to satisfy and law, regulation or government request.

11)           Property owners are responsible for investigating and adhering to all local regulations including but not limited to permits, licenses, occupancy taxes and safety compliance.

12)           Stay and Play Vacations, Inc. reserves the right to review, revise, or reject any ad submitted at our own discretion.

13)           You acknowledge that any transmission to and from this site is not confidential and your communications may be read or intercepted by others. You acknowledge that by submitting communications to us and by posting information on the site, no confidential, fiduciary, and contractually implied or other relationship is created by you and us other than pursuant to these terms.

14)           Stay and Play Vacations, Inc. owns the rights to all information submitted and no information obtained form this site may not be copied without the express written permission of Stay and Play Vacations, Inc.

15)           You hereby indemnify Stay and Play Vacations, Inc. defend and hold harmless from and against any and all liability and cost incurred by the indemnified parties in connection with any claim arising out of your use of the site. This is to include without limitation any dispute between users regarding any transaction or any of your user contributed content. Any content posted by you or any of your user of your account to the site or any breach by you of these terms or the representations, warranties and covenants made by you herein, including, without limitation, attorneys fees and costs. You agree to cooperate in any litigation in the defense of any claim against Stay and Play Vacations, Inc.

16)           This site may link or point to other internet sites. Links to third party site maintained by a third party does not constitute an endorsement by us of any third party sites or their contents.

17)           Stay and Play Vacations, Inc. will not and does not tolerate the transmission of SPAM and reserves the right to cancel any customer that mentions Stay and Play Vacations, Inc. and any associated websites, URL”s  or email addresses in a SPAM email message. Stay and Play Vacations, Inc. is the sole determiner in what constitutes SPAM.

18)           The advertiser or owner of property listing may not use any space for the advertisement either directly or indirectly of any business, property listing, service or product other than which the advertising space is provided by Stay and Play Vacations, Inc. unless expressly permitted by Stay and Play Vacations, Inc.

19)           Stay and Play Vacation, Inc. reserves the right to review all listings and advertisements and determine at our sole discretion to amend the content, layout and photographs supplied by our customers. All content, photos and layout is subject to review, edit, and final approval by Stay and Play Vacations, Inc.

20)           By placing an advertisement or property listing on our Stay and Play Vacations, Inc. site, you are acknowledging ownership or you are an owner-approved agent of the property owner for which you are placing property listings or advertisements.

21)           By placing an advertisement or property listing on our Stay and Play Vacations, Inc. site you acknowledge you must abide by Federal Fair Housing Laws and Regulations. By failure to do so, at Stay and Play Vacations, Inc. sole discretion, we reserve the right to cancel or revoke advertisement or property listing placement without any and all refund.

22)           Stay and Play Vacations, Inc. is regretfully unable to return photographs to you or retain paper copies in our files. We are not responsible for any loss or damage of your photos.

23)           Personal information and data may be disclosed to legal authorities if requested by Stay and Play Vacations, Inc.

24)           Stay and Play Vacations, Inc. does not guarantee that the StayandPlayVacation.com web site will be available one hundred percent of the time.

25)           Stay and Play Vacations, Inc. reserves the right to amend any portion of these Terms and Conditions at any time. Notification of changes to these terms will be posted on this site and will be effective immediately thereafter. Your continued use of the site after amended will constitute your acceptance thereof.

26)           If you are dissatisfied, during the first month of your property listing or advertisement, we will cancel your listing and send you a refund less a seventy five dollar administrative fee.

27)           Forty-five days prior to expiration of your advertisement or property listing you will be notified via email transmission of your expiration date and requested by Stay and Play Vacations, Inc. to respond via email transmission if you do not wish to renew. If you wish to cancel your listing with Stay and Play Vacations, Inc. you will be required to reply to our notification to cancel. If you do not reply Stay and Play Vacations, Inc. will automatically renew your advertisement or property listing charging the credit card Stay and Play Vacations, Inc. has on file the current fee for your advertisement or property listing.
